Protect Your Rights When Dissolving a Florida Marriage

Florida law uses a no-fault divorce system, meaning that a spouse seeking to end a marriage is not required to blame the other spouse for the dissolution of the relationship. Instead, the spouse who files for divorce need only show that the marriage was legal in the first place, that at least one spouse has been a Florida resident for six months or more, and that either the marriage is “irretrievably broken” or one of the spouses has become mentally incapacitated.

In addition, state law allows for a simplified and relatively speedy divorce procedure under certain circumstances when the spouses agree on basic issues. In order to be eligible for the simplified process, the spouses must not have any minor children and must not be seeking alimony, or monetary spousal support, from each other. They also have to agree to divide all property and debts and acknowledge that the marriage is irretrievably broken.

For couples who do not qualify for the simplified version, there is a longer judicial process. It typically requires appearing before a local judge and disclosing a variety of financial information and other evidence so that the court can rule on certain key issues. These may include alimony, child custody, child support, and property division.
