Pursuing a Contested Divorce

There are a number of ways to resolve a divorce case in Florida, including through alternatives to traditional litigation like mediation and the use of prenuptial and postnuptial agreements. There are some situations, however, in which contested legal proceedings may be the only option. In these cases, it is important to have a professional and experienced legal advocate in your corner.

Florida operates under a no-fault divorce system in which spouses who part ways do not have to point the finger at each other. Instead, one of the spouses must simply assert that the marriage is “irretrievably broken” and that certain jurisdictional requirements have been met. Where things can get more complicated is when it comes to issues related to the divorce, such as how the couple’s property will be divided, how their kids will be cared for, and whether either spouse is entitled to financial support.

Florida law requires that a couple’s property and assets be divided in a way that is equitable or fair. This could mean that the property should be split evenly, or that a judge chooses another form of distribution based on the circumstances. While the law gives courts considerable discretion regarding how to distribute property in a divorce case, there are a number of factors that judges are obligated to consider in the process. These include the contributions that each spouse has made to the household, the length of the marriage, the couple’s economic circumstances, and whether the home is to be maintained as a residence for any children.

Alimony or spousal support is a legal remedy that courts award in some divorce cases – or that divorcing spouses can agree to handle themselves – in order to ensure that one spouse can meet his or her basic needs and maintain the same standard of living enjoyed during the marriage. In deciding whether to award alimony, a judge is expected to take into account the marital standard of living, the spouses’ financial resources, and their educational levels and earning capacities, among other factors.
