Although Florida law allows some couples to get divorced quickly and relatively painlessly through a simplified process, that option will not be available to everyone. Uncontested divorce proceedings are available only for spouses who do not have minor children, have agreed how they will divide their property, and do not plan to seek alimony from each other. All other cases must go before a judge. When issues like property distribution, spousal or child support, and child custody are disputed, a trial may be necessary to resolve them.

How a Florida divorce case proceeds, and how long it takes to make the marriage dissolution final, depends largely on the circumstances. In some cases, spouses can file a complaint for divorce to start the legal proceedings while they work to settle some or all of the issues. The spouses will likely still need to file financial disclosures, take a parenting class if appropriate, and try to mediate any differences between them, but they will also get a chance to resolve the matter once and for all in a formal hearing.

When techniques such as mediation prove unfruitful, a full trial may be necessary. Each spouse will likely need to attend depositions, in which the opposing spouse’s lawyers ask questions on the record, and they will be expected to present detailed evidence to support their positions. That evidence may include income, assets, and property records, as well as evidence that aids in understanding the best interests of the couple’s children. A final trial is much like a trial in any other case. Each side gets the opportunity to present evidence and to rebut the other side’s arguments. These trials can last anywhere from a few hours to several weeks.
